1. Application of the general terms and conditions of sale

These general terms and conditions of sale apply to all use of and all orders placed on the starbay.com website.

Starbay.com reserves the right to adapt or modify these terms and conditions. These conditions apply to all purchases when the customer orders via the starbay.com website or by telephone using our customer service. The general conditions of sale applicable to any transaction are those appearing online on the site at the time of the order.

The site is published by Starbay, a brand of the company Centrale Distribution, SAS with a capital of € 120 000 Euros. This company was created in 1977 and has its registered office at Créteil (94000) 7-9 rue Jean Jaurès. Registered with the Créteil trade register under number 1986 B 19547. The intra-community VAT number is FR 57 306 771 536.

2. Products

The items offered for sale are those described on the Site. Photos of items are non-contractual. There may be minor differences between the items delivered and those shown on the website. 

Whilst every effort is made to ensure that the colours and design of Starbay items shown on our website reflect the original items, variations may occur due to technical limitations in reproducing colours on the customer's computer equipment. Consequently, Starbay cannot be held responsible for any negligible error or inaccuracy in the photographs or representations of the items displayed on the starbay.com website.

If the customer has any questions about the items, they can of course contact our customer service department.

3. Delivery zone

These GCS apply exclusively to items delivered to customers residing in the following countries: Metropolitan France, the Principality of Monaco, Belgium, Luxembourg, the Netherlands (excluding the Netherlands Antilles and Aruba), Scotland, Ireland, the United Kingdom, Italy, Spain, Portugal, Germany and Switzerland. Orders placed through our website cannot be validated for delivery addresses outside this delivery area. 

For deliveries outside these areas, the customer must contact Starbay by telephone or e-mail.

4. How to order

Orders placed on the www.starbay.com website are subject to compliance with the procedure implemented by Starbay and described below.
It consists of a series of steps with successive phases that the customer must follow:

A. Selection of a product by the customer on the site

The customer selects and confirms the identification and quantity of the items they wish to order. These items are added to the customer's "basket".

B. Reviewing the content of the online selection

The customer may freely consult and modify the contents of the "Basket" by deleting an item originally selected, changing the quantities ordered or adding an item. This is done by clicking on the corresponding tools available in the "Shopping Cart". The prices of the items are automatically displayed.

C. Confirm selected items and place the order

When the customer has finished making their selection, identification is required to confirm the contents of the "Shopping Cart". The customer must also confirm the delivery address, the shipping method, the delivery costs for the order being specified at this stage, and the chosen payment method. The customer must validate their order and the contents of the basket are transferred directly to the order preparation department and the customer's order number is displayed.

D. Acknowledgement of order

Starbay acknowledges receipt of the customer's order without delay by sending an automatic e-mail to the customer's e-mail address. This automatic e-mail is confirmation that the customer's order has been registered, but does not constitute acceptance of the customer's order.

E. Starbay's acceptance of the order

This takes place at the latest within six days of the acknowledgement of receipt. Starbay confirms acceptance of the order by sending an e-mail to the customer. This e-mail confirmation will indicate all the information relating to the order, including the availability of the items ordered, the delivery times and the chosen method of payment.

5. Prices and payment

Price determination

The prices of the items are indicated in euros, including all taxes and excluding delivery.

Delivery costs are given separately and at the same time if it is possible to calculate them automatically. If this is not possible, a quotation will be drawn up by our services and sent to the customer.

For goods on order, a deposit of at least 50% of the total price will be required when the order is placed. The customer will be notified by us as soon as the goods have been restocked. The balance must be paid before the order is dispatched to the customer.

For deliveries outside the EU zone, French VAT will be deducted and prices will be displayed tax-free.

Starbay reserves the right to modify its prices at any time. However, items will be invoiced on the basis of the prices in force at the time the order is received, subject to availability.

Terms of payment

Items are payable in full on the day the order is placed. Purchases must be paid for either by :

Credit/debit card:

Customers are directed to a dedicated area provided by the bank which ensures the security of transactions and records the payment order. In this respect, customers hereby expressly acknowledge that providing their bank card number is deemed to be an authorisation to debit their account for the amount corresponding to the items ordered.

Bank transfer:

The bank account identification information provided to make the transfer is assured by e-mail to customers. Orders paid by bank transfer will be processed upon receipt of the deposit transfer. The data recorded and kept by Starbay constitutes proof of the order. The data recorded by the payment system constitutes proof of the financial transaction.

Payment by cheque:

Payments by cheque must be made in euros and in full when the order is placed. They are reserved for invoicing in France. On the payment method page, select "bank cheque" then confirm.

In "My account", print out your order. These details can be copied onto plain paper.

Please indicate your order reference on the back of your cheque.

The cheque must be issued by a bank domiciled in France and made payable to STARBAY.

PLEASE NOTE: if you pay by cheque, delivery times will be extended. They will take into account the time it takes to receive and process your cheque.

6. Delivery

Items will be delivered to the delivery address specified when the order was placed. The address must be the residence of the customer or any other natural person residing in the delivery area (in accordance with article 3 above).

Delivery to Corsica, the islands and abroad is subject to an estimate and acceptance by the customer.

In the event of delivery outside mainland France by the customer himself, a consignment note stipulating the address of arrival must be provided to Starbay no later than the day of collection, failing which French VAT will be payable.

For security reasons, Starbay will not process any order where the address corresponds to a hotel, post office box or university residence address.

Delivery takes place once the order has been paid for in full, i.e. within the time specified when the order was placed.

Collection from warehouse :  

Customers can choose to collect items ordered on starbay.com from our warehouse near Paris by appointment. This service is offered to starbay.com customers when selecting the delivery address.

Delivery by carrier :

Comfort delivery (France only)

The order will be delivered by a carrier specialised in delivering furniture to the room indicated by the customer. The shipping department will contact the customer to arrange a delivery date within the period indicated on the order summary.

Before placing an order, the Customer must check the dimensions of the Products to ensure that they can be delivered via the normal access to the location where the Customer intends to place them. Starbay will not be liable if the goods ordered by the customer cannot be delivered via the normal means of access. The cost of delivery will then be due to Starbay and another delivery, at the customer's expense, may be envisaged using other means (furniture lift) if the case so permits or the customer will have to contact Starbay to exchange the contents of his order.

Unless otherwise stipulated in the order, items in stock will be delivered within approximately 20 working days from order confirmation in mainland France. The Starbay carrier will call the customer to arrange a delivery time of approximately 4 hours.

If the carrier is unable to deliver the products on the agreed date because the customer is not present at the time of delivery, or if the carrier has not been informed of any special delivery requirements, the customer will have to pay the additional delivery costs.

If some of the products in the order are available at different times, Starbay offers to deliver them as soon as they are all available. If the customer does not choose this option, delivery charges will apply to each shipment.

Before signing the delivery note, the Customer must check the condition of the goods and the number of packages. Once the delivery note has been signed, no claims will be accepted. 

Express delivery

The order will be delivered by a carrier specialising in the delivery of furniture on pallets. The carrier will notify the customer of the day of delivery. 

Delivery will take place within the time indicated on the order summary.

Unless otherwise stipulated in the order, items in stock will be delivered within approximately 10 to 20 working days from order confirmation in mainland France. And less than 4 weeks in other countries.

The customer will receive an estimated delivery date when placing an order on the site. The carrier will notify the customer of a delivery date.

If the carrier is unable to deliver the products on the agreed date because the customer is not present, or if the carrier has not been informed of any special delivery requirements, the customer will have to pay the additional delivery costs.

If some of the products in the order are available at different times, Starbay offers to deliver them as soon as they are all available. If the customer does not choose this option, delivery charges will apply to each shipment. 

Before signing the delivery note, the Customer must check the condition of the goods and the number of packages. Once the delivery note has been signed, no claims will be accepted. 

7. Force majeure

The following are considered to be cases of force majeure, in addition to those usually accepted by the jurisprudence of the French courts and tribunals, and without this list being limitative: flood, fire, storm, lack of raw materials, transport strike, partial or total strike for any reason whatsoever, government or legal restrictions, computer breakdown, blockage of telecommunications including networks and in particular the Internet.
The occurrence of a case of force majeure will initially suspend performance of the order ipso jure.
If, after a period of three months, the parties establish that the case of force majeure persists, the order will be automatically cancelled, unless both parties agree otherwise.

8. Right of withdrawal

In accordance with Articles L.121-20 et seq. of the French Consumer Code, private consumers (as opposed to businesses) have fourteen (14) clear days from the date of delivery to exercise their right of withdrawal without having to justify their decision.

By registered letter with acknowledgement of receipt, the customer must unambiguously express their wish to withdraw, enclosing a copy of the invoice, the order number and the delivery date. The customer must return the goods (accessories, instructions, etc.) within the period indicated, in their original packaging and in the same condition in which they were delivered. The cost of returning Starbay items will be borne by the customer. The refund of the returned items will be made by crediting the customer's bank account as soon as possible and within a period not exceeding thirty days from the customer's notification of the termination of the contract and after receipt by Starbay of the returned items. Items returned incomplete, damaged, deteriorated or soiled by the customer will not be refunded. Where Starbay items are delivered to a third party chosen by the customer, the right to cancel the contract under this article may not be exercised by the customer and may in no circumstances be exercised by the third party.

9. Warranty

All items are guaranteed against manufacturing defects. Items are guaranteed to be free from design defects for a period of 2 years from the date of delivery for residents of the European Union. During the guarantee period, Starbay will exchange or reimburse items for which Starbay has given its agreement after the defects have been detected. To implement the guarantee, the customer must send us by registered letter a description of the defects found, a copy of the invoice as well as one or more photos of the items highlighting the defects found.

The guarantee only applies to normal (non-professional) use. This guarantee does not cover :

  • Damage to items caused by natural wear and tear.
  • Items exposed to excessive use, in particular use other than for private purposes.
  • Any damage to items resulting from poor maintenance.
  • Incorrect or improper use.
  • Any modifications or repairs carried out by the customer or a third party.
  • Damage caused by other objects, external events such as accidents, impacts, fire, vandalism, water damage or natural light.
10. Applicable law

All the clauses contained in these general terms and conditions, as well as all the purchase and sale operations referred to herein, are subject to French law. In the event of a dispute, the French courts shall have exclusive jurisdiction. In the event of difficulties or complaints concerning an order, customers may contact customer services in order to reach an amicable solution.

11. Protection of personal data

In accordance with the Data Protection and Privacy Act of 6 January 1978 relating to data processing, files and freedom of information, any person has the right to access, rectify and object to personal data concerning him or her.
